END-USER-LICENSE AND TERMS OF USE

COLOPLAST HCP UNIVERSE

Coloplast A/S, a Danish company with company reg. no. 69749917 and the registered address Holtedam 1, 3050 Humlebæk, Denmark (“Coloplast”) provides the Coloplast HCP Universe Platform and its related content (“Platform”) licensed to the end-user (“User”).

END-USER-LICENSE

Coloplast hereby grants User a revocable, non-exclusive, non-transferable, limited license to create a profile and use the online Platform, solely for personal, non-commercial purposes strictly in accordance with the Terms of Use set out below.

TERMS OF USE

By using the Platform, you agree to be bound and abide by these Terms of Use and any later amendments hereto.

This Platform is intended only for Users with a health care professional (HCP) background mainly within ostomy, continence, bowel, urology, or wound & skin medical care. The information, views and opinions expressed in the content, this site and in the materials presented are those of the individuals involved and do not necessarily represent those of Coloplast. Coloplast is not responsible and does not verify the accuracy of any of the information or material presented at the site. Some information may be gathered from third party sources and is subject to change without notice and some presenters may have been compensated by Coloplast to share the information. The information presented may not be appropriate for all jurisdictions.

This Platform is provided for your own personal use and you may not share, distribute, copy, duplicate or sell the Platform or other content to others without written permission or consent by Coloplast By using the Platform, you agree that you will not copy or modify the Platform or any part thereof or Coloplast’s own or licensed trademarks or content in any way. There may be additional terms of use to download or use certain materials on the Platform or website. You also agree that you will not attempt to extract the source code of the Platform, nor translate the Platform into other languages or make derivative versions.

By using the Platform Coloplast may store your personal data in accordance with Coloplast’s Data Privacy Policy also available in the “About” section in the Platform menu, for contractual performance, to pursue legitimate interests of Coloplast or based on your consent for data processing. Coloplast will process user data in order to manage data & profiles, track individual usage, improve content, service & products through data analytics.

In addition, by creating an account and login you agree to receive information regarding any content changes or updates, requests for feedback, surveys, or new or upcoming topics of interest. You will not receive marketing content or other promotional materials without explicit consent.

Updates and Links

The Platform will be updated when Coloplast considers it necessary. Coloplast recommends that you install all updates to ensure that the Platform will function correctly and will be kept up to date.

Coloplast reserves all intellectual property rights in the Platform, website and content.

Coloplast does not provide medical professional advice and use of the Platform is not professional medical advice and is not intended to substitute for the advice of a health care provider/professional. Any recommendations in the Platform or educational resources are a general guide, to be evaluated, adapted and implemented by qualified healthcare professionals subject to clinical judgement and consideration of the patient’s individual needs, characteristics, and personal preferences. neither Coloplast nor any of its affiliates will be liable for damages of any kind (including without limitation liability associated with any computer viruses that may infect your computer system, lost profits, direct, indirect, compensatory, incidental, consequential, exemplary, punitive, or other damages) arising out of your use of, your inability to use, or the performance of the Platform or arising out of or related to the content or links to other websites or content whether or not Coloplast has been advised of the possibility of such damages.

However, Coloplast makes no warranties or representations as to the accuracy, availability, reliability, or correctness of the Platform, content, or information. Governing law and venue

These Terms of Use, including any disputes arising out of the use of the Platform, are governed by and construed and enforced in accordance with the substantive law of the State of Minnesota and the venue of any judicial dispute shall be the federal or state courts in Hennepin County, Minnesota.
